Right of withdrawal for consumers and exclusion for entrepreneurs

Consumers have a statutory right of withdrawal in accordance with the withdrawal policy. However, customers who act as entrepreneurs or on behalf of a company (in accordance with §14 of the German Civil Code) have no right of withdrawal or return in accordance with §312g of the German Civil Code in conjunction with §355 of the German Civil Code. The right of withdrawal applies exclusively to consumers within the meaning of §13 of the German Civil Code who conclude a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

by means of a clear statement (e.g. a letter sent by post, fax or email) about your decision to revoke this contract. You can use the attached sample revocation form for this purpose, but it is not mandatory. To comply with the revocation period, it is sufficient to send the notification of the exercise of the right of revocation before the end of the revocation period.

In the event of revocation of this contract, we are obliged to refund you all payments that you have made to us, including delivery costs (except for additional costs arising from your decision to choose a delivery method other than the cheapest standard delivery offered by us), immediately and no later than fourteen days after receipt of your revocation declaration. The refund will be made using the same payment method that you used for the original transaction, unless expressly agreed otherwise. In any case, you will not be charged any fees for the refund.

We reserve the right to refuse a refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs earlier.

You are obliged to return or hand over the goods to Tie Solution GmbH, Returns, Gießener Str. 72, 35415 Pohlheim immediately and in any case no later than fourteen days after receipt of your revocation declaration. The deadline is deemed to have been met if you send the goods before the expiry of the fourteen-day period. You bear the direct costs of returning the goods yourself. For goods that cannot be shipped by parcel post, the estimated maximum amount for the costs is set at approximately 80 EUR.

You are only liable for any diminished value of the goods if this loss in value is due to handling of the goods that was not necessary to ascertain the nature, characteristics and functioning of the goods.

Exclusion or expiry reasons

The right of withdrawal does not apply to contracts:

for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

for the delivery of imported products whose price was agreed upon at the time of contract, but which can be delivered no earlier than 30 days after the contract is concluded and whose current value depends on fluctuations in the market over which the entrepreneur has no control;
for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;

Your return

Before returning the goods, you must register the returns. Otherwise, a handling fee of see current terms and conditions version of the value of the goods will be charged. This also applies to samples!

We only accept returns of new, unprocessed goods.
The delivery must not be more than 14 days ago.
Write the invoice or delivery note number given in the return registration on the return slip.

During the return process, you have the option to select a return label for returns from Germany. In this case, you will receive a return label (DHL/DPD) from us via email, and a net amount of 5.95 € will be deducted from your refund. (Unfortunately, return labels cannot be created for returns from abroad.) If you choose a different shipping provider, please make sure to choose appropriate packaging according to the provider's shipping conditions.
After checking and processing your return, you will receive your credit, if applicable, minus handling fees, by email.

Severability clause

If individual provisions of these general terms and conditions are or become invalid in whole or in part, or if they contain a gap, the validity of the remaining provisions shall not be affected.
